You agree to submit to the exclusive jurisdiction of the courts located in Multnomah County, Oregon, for the resolution of any and all disputes arising out of or relating to your use of this Site.

My Ardon App Terms of Use

These terms of use apply to individuals who enroll in or use the My Ardon app provided by Ardon Health. Please read these terms of use carefully. If you do not agree to any and all of these terms and conditions, do not access or use the My Ardon app or text message or email notifications.

About the My Ardon app

The My Ardon app allows you to schedule prescription refill reminders, receive educational information, and communicate with the patient care team at Ardon Health. The app can be downloaded at no cost for use on both iOS and Android devices. The My Ardon app is intended for use only in the United States.

Enrolling in the My Ardon app

You must enroll in the My Ardon app. You can choose to enroll by text message or email. Message and data rates may apply if you enroll by text message. Check with your wireless carrier for details. Call us at 855-425-4085 to enroll in the My Ardon app. You can opt-out of the My Ardon app at any time. If you opt-out or choose not to enroll, you will be able to communicate with Ardon Health by telephone.

Opting-out of the My Ardon app

You can opt-out of the My Ardon app at any time. You can delete the app or opt-out of different types of communications. To opt-out of text messages, reply STOP to a text message from Ardon Health. You can also opt-out within the My Ardon app. Go to Profile Settings, choose Personal Settings and click the “No” button under Enable SMS Notifications. If you wish to opt-in again, you must wait at least 30 days. To opt-out of emails, go to Profile Settings, choose Personal Settings and click the “No” button under Enable Email Notifications. You can also call us at 855-425-4085 to opt-out or change your communication preference.

Contact us if your cell phone number changes

Please notify us promptly if your cell phone number changes. You will need to re-enroll in the My Ardon app with your new number. Call us at 855-425-4085 to notify us or if you have questions about re-enrolling.

My Ardon app chat feature

A chat feature on the My Ardon app allows you to communicate directly with Ardon Health. The chat feature is available Monday through Friday from 8:00 A.M. to 6:30 P.M. Pacific Time. Outside of these hours, please call Ardon Health at 855-425-4085 to speak with an on-call pharmacist. If you use the chat feature, you agree not to post any content that is illegal, obscene, defamatory, threatening, or injurious. If you post content in the chat feature, you grant to Ardon Health the non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to use, reproduce, publish, and modify the content in any media for any lawful purpose. Ardon Health reserves the right to edit or remove any content posted in the chat feature.

My Ardon app user conduct

The My Ardon app is intended for use only by Ardon Health’s patients and their caregivers. Ardon Health reserves the right in our sole discretion to suspend or ban users at any time and without notice for any unauthorized use of the My Ardon app or any abusive, disruptive, or prohibited activity or behavior.

Receiving refill reminders by text message or email

If you prefer not to use the My Ardon app, you can choose to receive prescription refill reminders by text message or email. Message and data rates may apply if you choose text messages. Check with your wireless carrier for details. Call us at 855-425-4085 to enroll in refill reminders by text message or email.

Collection, use, and disclosure of user and device data

By enrolling in and using the My Ardon app, you consent to Ardon Health collecting certain data and information about you and your device. We collect any content or images you send to us. We will not sell your data or information. We will not share your data or information with any third party without your prior consent unless the disclosure is required or permitted by law. The data and information we collect will be retained for as long as required by law or company policy. Click on Privacy Policy at the bottom of this page for more details about how Ardon Health may use your data and information.

Consent to receive push notifications

By using the My Ardon app, you agree to receive push notifications from Ardon Health. Push notifications may include prescription refill reminders and educational information. You can opt-out of the My Ardon app at any time by calling us at 855-425-4085.

Warranty

The My Ardon app, including information offered through the app, and text message and email notifications are provided AS IS and AS AVAILABLE, without representations or warranties of any kind, express or implied. Ardon Health hereby disclaims all warranties and conditions with regard to the My Ardon app, content available on the app, and text message and email notifications, including any implied warranties of merchantability and fitness for a particular purpose. Ardon Health reserves the right, in our sole discretion, to modify, replace, or cancel the My Ardon app at any time and for any reason without prior notice to you.

Limitation of liability

Ardon Health is not responsible for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from your use of or inability to access the My Ardon app, text message or email notifications, or information provided through the app. Your sole remedy for dissatisfaction with the My Ardon app is to stop using the service.

Indemnification

You agree to defend, indemnify, and hold harmless Ardon Health, its parent, affiliates, independent contractors, service providers, consultants and their respective officers, directors, employees, and agents, from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to attorneys’ fees) arising out of or related to the My Ardon app, the content that you share, your conduct, your violation of these terms of use, or your violation of the rights of any third party.

Governing law

Apple End-User License Agreement (EULA)

If you access the My Ardon app on an iOS device, the End-User License Agreement (EULA) below includes additional terms and conditions that apply to you.

Acknowledgement: By enrolling in and using the My Ardon app, you accept the terms and conditions of this EULA. You also acknowledge that this EULA is between you and Ardon Health, and not with Apple. Ardon Health is solely responsible for the My Ardon app and notifications and content thereof.
Scope of License: The My Ardon app and the platform on which it is provided are the sole and exclusive intellectual property of Ardon Health or our suppliers. Ardon Health grants a limited, non-exclusive, non-transferrable, revocable license to use the My Ardon app in the United States for the sole purpose of managing your prescriptions with Ardon Health and communicating with Ardon Health. All other rights, title, and interest in the intellectual property rights related to the My Ardon app are expressly retained by Ardon Health or their rightful owner. The limited license extends to any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service. The limited license may be accessed, acquired, and used by other accounts associated with you via Family Sharing or volume purchasing.
Intellectual Property Rights: In the event of any third-party claim that the My Ardon app or your possession and use of the app infringes on the third party’s intellectual property rights, Ardon Health and not Apple will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Product Claims: Any claims related to the My Ardon app must be communicated to Ardon Health. Apple is not responsible for any claims related to the My Ardon app.
Maintenance and Support: Apple is not providing maintenance or support for the My Ardon app. Contact Ardon Health at 855-425-4085 if you have maintenance or support questions.
Warranty: To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to the My Ardon app. Any claims, losses, liabilities, damages, costs, or expenses related to your use of the My Ardon app must be addressed to Ardon Health.
Legal Compliance: By using the My Ardon app, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. government embargo or that is on the list provided in Title 15, Party 740 Supplement 1 Country Group E of the U.S. Code of Federal Regulations; and (2) that you are not on any U.S. government list of prohibited or restricted parties.

Third Party Terms of Agreement: Users of the My Ardon app must comply with any applicable third-party terms and conditions, such as those provided by your wireless carrier.
Third-Party Beneficiary: Apple is a third-party beneficiary under this EULA. This means that Apple and Ardon Health both have the right to enforce the terms and conditions of the EULA.

Additional fees may apply

The My Ardon app is free to download. Please check with your wireless carrier or review their terms of use to see if any additional fees may apply to your use of the My Ardon app or text message or email notifications. Message and data rates may apply to text messages.
